Please read these Terms and Conditions and our Privacy Policy (together, the “Terms”, “Terms of Use”) carefully. By using our services and/or reading this website, you signify that you have read, understood and agree to the Terms of Use. If you do not agree to the Terms of Use please do not use our website, Products & Services.
Products: Prescriptions including herbal medicine: liquid tinctures, tablets, powders, creams; nutraceutical supplementation: tablets, capsules, powders, creams; educational resources; merchandise.
Services: Naturopathic and Nutrition appointments and/or bookings; personalised written treatment plans.
These documents govern the legal relationship between you and us in the use of our Products & Services.

Acceptance of Terms
By remaining on this website, you accept the Terms presented below.
These Terms apply to you if you purchase our Products and/or Services and use information from Klara Walsh Naturopathy on this website or other social media accounts operated by us.
In purchasing these Products and Services, you accept that you will comply with the Terms outlined in this document and are over the age of 18 years old, or are the legal guardian/parent of a child under the age of 18 years old.
Fees and Payments
Klara Walsh Naturopathy will inform you of our Service and Product prices. Appointment pricing will be available upon request at the time of making a booking or when booking an initial, follow-up or acute appointment, or when purchasing the preconception and postpartum packages on this website. When making a booking, you are agreeing to pay the required appointment fee. We will inform you of the fees associated with our Services including any postage and delivery fees. We will provide invoices for fees charged by us for Products and Services. We will inform you of cancellation fees at the time of your booking. You agree to pay any cancellation or failure to attend fees as set by these Terms.
We may use third-party supplier companies to fill and dispatch prescriptions containing Products. Postage charges are determined by these companies.
Product and Services Pricing
Pricing on this website and on any invoice issued by us is in Australian Dollars. All prices are subject to change with notice. Unless otherwise provided in the Terms, prices for Products and Services are fixed once the invoice is issued.
GST
If and when GST is payable on our Products and Services, it will be displayed on the provided invoice. By accepting these Terms you are agreeing to pay the required GST.
Payments
Payments for Services including initial, follow-up and acute appointments for children and adults, and the preconception and postpartum packages, must be paid before receiving Products or treatment plans. We accept payments via bank transfer or Stripe. Any financial information entered is stored under Stripe’s security policy.
Payments are due 24 hours from the date the invoice is issued. If there is a problem with payment, please contact me as soon as possible to make alternative arrangements. I will not provide your treatment plan until payment has been received.
Refund Policy
If you request a refund on a Service or Product, we request you email us at klara.naturopath@gmail.com outlining the reasoning for the request and the amount of the refund. We will consider your request and notify you of the outcome within 30 days.
Disclaimer and Limitations of Liability
Products and Services
It is the responsibility of yourself to ensure the Products or Services meet your needs or the needs of your child. You must consider if our Products and Services are appropriate to be used by yourself or your child. Where appropriate, you should consider consulting with your health care practitioner or other health care professionals before starting your Product or Service.
Outcomes
We do not and will not make any guarantees of the outcome or results of our Products and Services including the cure or resolution of any disease and/or condition.
Disclaimer
When providing Products or Services, we may provide personalised advice as a result of the information you have provided. We will not provide advice outside of our Scope of Practice. We strongly recommend that you discuss the recommendations provided during an appointment, written in an email or written in a treatment plan with your health care professional of choice before actioning the advice. Any actions taken or not taken as a result of the advice and recommendations we provided is your choice. You will hold us harmless against all losses, costs and expenses under Australian Consumer Law: Competition and Consumer Act 2010.
Limitation of Liability
Klara Walsh Naturopathy exclude all liability for any damage or loss of any kind including indirect incidental, specials, consequential or exemplary damages. These include but are not limited to the use, goodwill, data, cost of procurement of substitute foods or services, or any indirect consequential damages in anyway connected with our Products and Services.
Indemnity
You agree to and are liable to indemnify, defend and hold us harmless against, and for any and all claims, suits, liabilities, actions, expenses including litigation and/or legal costs resulting directly or indirectly from any information that is inaccurate, not up to date, not complete or misleading or misrepresented. You agree to and are liable for any misuse of the Products and Services, breaches of the law by you, and/or any breach of the Terms or documents provided.
Disputes
You agree to cooperate with us at your own expense in handling any and all complaints, disputes, investigations or litigations that arise from your use of our Products and Services.
Third-party use
Klara Walsh Naturopathy is not responsible for service or performance issues caused by any third-party website or third-party service provider. We reserve the right to determine whether we are responsible for the issue caused including malfunction or disruption.

Confidentiality & the Law
Klara Walsh Naturopathy may share personal information in specific circumstances, where there is a reasonable belief that it is necessary to identify, contact, or take legal action against individuals who may be causing harm, interference, or damage to our rights, property, users, or others who may be affected by such actions.
We will disclose your personal information if required to do so by law or subpoena, or if requested by law enforcement, or to protect the security of our Service.
Communication
Disrespectful or aggressive behaviour towards myself or anybody else will not be tolerated on this website, via email, over the phone or on other social media accounts owned and run by Klara Walsh Naturopathy. We reserve the right to moderate all comments and actions on these platforms. By agreeing to the Terms, you agree to refrain from engaging in public discussions that are disrespectful, aggressive, inappropriate and/or intentionally or unintentionally negatively impact my business and/or personal reputation.

All trade names, trademarks and images of people used by Klara Walsh Naturopathy on this website and our social media accounts are either the property of, or used with permission by, Klara Walsh Naturopathy. The use of this content by you is strictly prohibited unless specifically permitted by these Terms. Any unauthorised use of the trade names, trademarks and images of people may violate the copyright, trademark and other proprietary rights of Klara Walsh Naturopathy and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. We respect the copyright, trademark and all other intellectual property rights of others.
By agreeing to the Terms, you agree to not reproduce, duplicate, copy, sell, resell or exploit any portion of our Services or any contact on this website without written permission by us.
Content Policy
All naturopathic and nutritional information about diet, herbal medicine and lifestyle provided by Klara Walsh Naturopathy on this website and our social media accounts is solely for educational and entertainment purposes. It is your responsibility to consult with your health care practitioner/professional before making any changes that could potentially impact your health.
Appointments
Bookings
Bookings are to be made through the booking system found on this website, via email, over the phone or in person at the end of your appointment. Appointments are required to be conducted via Telehealth using a secure and HIPAA-compliant video system or in person at Broulee Health Hub located in Train Street Central: 21/40 Train Street, Broulee NSW 2537. You will be sent a meeting link when booking an online initial, follow-up or acute appointment. This link will need to be accessed at the beginning of your appointment.
Reminders
You will receive a reminder via email 48 hours before your scheduled appointment as a courtesy reminder. It is your responsibility to remember your appointment. Failure to attend an appointment with no notice will incur a fee of 100% of your appointment cost.
Intake Form
You will receive an intake form via email after booking an initial appointment. It is your responsibility to complete this form prior to the commencement of your appointment. If it is not completed by the time of your scheduled appointment, it will need to be completed during your appointment. With consideration and respect for our other clients, no additional time will be allocated to compensate for lost time.
Children
Bookings of those who are not the age of majority must be filled and completed by a parent or legal guardian with the minor’s details. The parent/guardian must be present at all appointments with the persons who are not the age of majority.
In Australia, the age of majority is any persons over the age of 18 years.
Telehealth
Please ensure you have a secure internet connection before beginning your appointment.
This appointment should not be conducted in situations or locations where privacy, confidentiality and safety cannot be assured. These include while driving, in public areas or in shared/communal spaces where others may overhear. It is strongly recommended that you find a quiet, secure location to conduct the appointment.
Cancellation or Failure to attend
We require 24 hours notice when cancelling your appointment. This ensures we can allocate the appointment time to another client. Failure to give 24 hours notice will result in forfeiting the $25 booking fee. Failure to attend your appointment with no notice will result in a cancellation fee of 100% of your appointment cost.
In the event of unforeseen circumstances beyond your control which prevent you from attending your scheduled appointment, please notify me as soon as possible to discuss further.
Refunds
Subject to the Terms and your rights under the Australian Consumer Law, we will not provide a refund for completed initial, follow-up and acute appointments. If you seek information or have questions regarding our Services you must enquire via email or over the phone before booking an appointment.
We do not offer refunds on opened, used or damaged Products (damaged once in your possession) or personalised Products that have been made specifically for you as they can not be reused or resold.
If an order is incorrect, made without your permission, faulty, damaged (prior to being in your possession), or has been recalled, contact us immediately and we will work toward a resolution within our Terms.
Product
By proceeding with your order, you accept the Terms. We may use third-party services that require you to set up an online account and pay for your Products prior to them being dispatched.
Damaged Goods
If your Products arrive damaged or faulty, please take photographic evidence and notify us immediately.
Cancellation of Orders
You will not be charged for your order of Products if you have provided written or verbal communication requesting the cancellation of your Products before they have been prepared and dispatched. If you have prepaid for the Products, you will be refunded the amount if they have not been prepared and dispatched. If we have created or made personalised Products for you or your child prior to your request to cancel your Products we will not be unable to provide you with a refund as these Products can not be resold.
Recalls
In the circumstance of a Product being recalled we will notify you immediately with the details of the recall and ask you to cease using the product.
Adverse Reactions
If you experience any new symptoms or adverse effects after commencing your treatment plan and/or prescription, please contact me immediately via email or phone and I will provide you with the appropriate information.
Products may come in contact with or have nuts, dairy, shellfish, gluten and other allergens. It is your responsibility to read the ingredients before purchasing a Product and contact us if you have any questions about the Product before purchasing. We will not be held liable for adverse reactions or allergic reactions to Products.
